| 内容記述 | The Japanese courts have a history to accept the abuse against other spouse as a divorce cause in Japanese Family Law. With the advancement of the domestic violence study, the actual situation of the DV is becoming clear than before. When examined the divorce cases from the standpoint of DV study, it can be said that the responses and correspondence of the Japanese courts cannot but be evaluated including host of various problems. This article, using subject matter as precedent judgements from Meiji era to present, evaluates whether the current courts demeanor is appropriate or not, and considers the approach to resolve the problems that appeared from DV study. | |||||
