内容記述 | The purpose of this essay is to explore how the international human rights regime has changed due to pressures of global feminism, while focusing on the process of abolishment of sexual violence at wars. As the warfare is the male habit, the sexual violence like rape at the time of wars has been thought inevitable and natural, and the female victims have been forced to keep silence. However responses to the sexual violence at wars recently changed. one of such examples is the International Criminal Tribunal for the Former Yugoslavia(ICTY). The statute of ICTY stipulates that rape must be punished as a crime against humanity. Although rape has been prohibited under the Geneva Conventions, it is treated as a crime against honor and dignity, which implies the value of the covert patriarchy. This shift from a crime against honor and dignity to a crime against humanity and gender indicates the fact that human rights of women have been gradually recognized even in the case of sexual violence at wars. It is certain that recent tragedies of Bosnia and Rwanda triggered this regendering of the international human rights regime, but it is global feminism that has contributed to the transformation of discourse regarding sexual violence in the times of armed conflicts. As feminist voices have transformed the international human rights regime, they have also begun to transmute the Westphalia System by fostering the global civil society and strengthening the international human rights regime. Although seeking for justice and regendering the human rights regime, it is also wrong to jump at the alternative such as the ethic of care. However the ethic of care, in which listening to voices of the so-called subaltern women is very important, can mitigate violence of the essentialism to make the coexistence of different moral approaches possible. | |||||
