| 内容記述 | 国際商事仲裁判断の承認・執行に関する拒否事由を規定した最初の条約は、ジュネーブ条約である。しかし、ジュネーブ条約の規定では、申立人に対し厳しい挙証責任を課しているため、裁判の過程において申立人に不利が及ぶ恐れを排除できなかった。この問題点はその後ニューヨーク条約の規定により、大幅に修正され、現在では、世界のほとんどの国が当該条約に署名している。その結果国際商事仲裁裁判の承認及び執行において、申立人の挙証責任問題は解消されたと考えられる。さらに、UNCITRALモデル法の誕生をきっかけにして、これを国内法化する国が増加しつつあるため、国際商事仲裁判断の承認及び執行は一層容易になっている。 | |||||||||

| 内容記述 | The Geneva Convention on the Execution of Foreign Arbitral Awards was the first international convention that stipulated the reasons to refuse recognition and enforcement of international commercial arbitral awards.However this convention has harsh regulations on burden of proof for applicants and is hard to implement. Therefore, when the new New York Convention was eracted, the above-mentioned situation was eased. At the present time, most countries in the world have signed the New York Convention, which basically removed the impediments in recognition and enforcement of international commercial arbitral awards. Moreover, UNCITRAL Model Law was put into force and it was adopted into domestic law by many countries. This move makes the recognition and enforcement of international commercial arbitral awards even easier. | |||||||||
